TERMS & CONDITIONS
All invoices must be paid within 7 days of the date of issue. Large projects (over £750) will require 25% payment upfront.
2. DEFAULT IN PAYMENT
If the client does not pay the invoice within the agreed time, they will be responsible for any legal costs incurred by Steph F Design (SFD) in collecting the overdue payment.
3. TIME & DEADLINES
Unless a specific deadline is agreed in advance, any timings given by SFD are for estimation purposes only. SFD will keep the client up to date on timings and will inform them of any changes in the schedule. If there is a specific deadline, SFD must be notified before the booking.
If there is a delay in the completion of the project due to unforeseen illness or events out SFDs control, the client will be notified straight away.
If the client does not respond within 7 days of any work being sent for approval/comments, SFD cannot be held responsible for any delays in the completion of the design.
4. CLIENT RELATIONSHIP
SFD is acting as an independent contractor, and not undertaking any project as any employee of the client, nor entering into a joint partnership. SFD reserves the right to seek advice or assistance if required.
All additions, alterations, changes in content/layout/process requested by the client will alter the time and cost of the project. The client shall offer SFD the first opportunity to make any changes. Any changes made by SFD will be charged at the agreed hourly rate.
All expenses, including but not limited to, stock imagery, fonts, digital items, printing and materials to be used in any design work created by SFD for the client will be added to the final bill. It is the clients responsibility to pay for these. If any additional expenses are required, SFD will provide the client with a quote and will require written confirmation before proceeding.
7. STOCK IMAGERY
Costs of any stock or digital imagery is not included unless specifically noted on the client’s invoice.
The client has the right to cancel an order at any point during the design process. In the event of cancellation any monies paid prior to cancellation are non refundable, and they will also be required to pay for any additional work that has been carried out prior to cancellation which has not already been paid for. Ownership of all copyrights and the original artwork shall be retained by SFD. Any usage of the artwork created by SFD prior to the project being cancelled will result in appropriate legal action.
In the unlikely event of SFD not being able to complete the project due to unforeseen illness or events out of her control, then another professional and reputable designer will undertake the artwork. SFD reserves the right to cancel the artwork at any given time without prior notice.
The copyright of all artwork created by SFD shall remain the property of SFD in accordance with the Copyright, Design and Patents Act 1996. The client shall have no right to alter, amend or adjust the artwork created by SFD by any means whatsoever without prior permission. The client hereby acknowledges that infringement of Steph F Design’s copyright is unlawful and may be a criminal offence. Artwork may be used in SFD's advertising material, magazines, website, blog or social media pages and consent is hereby given by the client. If the client wishes to retain the ownership of the rights to a specific design project, these may be purchased at any time for an additional cost. The client is fully responsible for making sure they have obtained full copyright or permissions to use any content in the artwork not provided by SFD. This includes all photography, copy and content, design elements and branding of other companies. SFD cannot be held responsible for any legal action taken against the client for unlawful use of any content within their designs.
All proofreading is the client’s responsibility. The client should thoroughly proofread all information to be included in their artwork prior to sending to SFD. A further proofread should be done once you have received the design. Any mistakes noticed after completion are not SFD’s responsibility. Any amendments will be charged at the agreed hourly rate.
Credit is not given for printing through Steph F Design. Colours of printed versions of your artwork may vary to that displayed on your screen. The overall finish may also differ to that of any artwork you may have printed elsewhere. SFD cannot be held responsible for any variations in colour or quality. All items to be printed through SFD shall require full proofing by the client (See Section 9). Any mistakes found after artwork has been printed, and any subsquent re-printing charges, are the client’s responsibility. If the client arranges to print artwork themselves, SFD cannot be held responsible for any errors in colour matching, finish or quality of the final printed product. SFD is not able to offer advice on printer issues, please refer to the manufacturer’s handbook or online help services.
Steph F Design shall not disclose any confidential information concerning design projects to any third party without prior permission.
Any complaints should be raised by the client in writing within 28 days of them becoming aware of the issue, or 28 days of receipt of the final artwork.
14. LIMITATION OF LIABILITY
The client agrees that it shall not hold Steph F Design or her agents liable for any incidental or consequential damages that arise from failure to perform any aspect of the project in a timely manner. This is regardless of whether such failure was caused by intentional or negligent acts or omissions of SFD, the client, any client representatives or employees, or a third party.
